Welcome to VidMagic. These Terms and Conditions ("Terms") govern your access to and use of the VidMagic mobile application and related services ("VidMagic", the "App", or the "Service").

VidMagic is developed and operated under the Akashsoft brand ("we", "us", or "our").

By downloading, accessing, or using VidMagic, you agree to these Terms. If you do not agree, please stop using the Service.

Please also read our Privacy Policy, which explains how information may be processed when you use VidMagic.

1. Eligibility and Accounts

You must be legally permitted to use VidMagic under the laws applicable to you. If you are not legally able to agree to these Terms yourself, you may use the Service only with the involvement and permission of a parent or legal guardian where required by law.

Some features may require you to create an account or sign in. You are responsible for providing accurate information, keeping your login credentials secure, and notifying us if you believe your account has been accessed without authorization.

You are responsible for activities performed through your account, except to the extent that applicable law provides otherwise.

2. Permitted Use

VidMagic provides video and audio editing tools and related functionality. Depending on the version of the App, available features may include trimming, splitting, merging, cropping, rotating, compressing, converting, audio processing, GIF creation, captions, and AI-powered media tools.

You may use VidMagic for lawful personal or commercial purposes, subject to these Terms, applicable laws, third-party rights, and any additional terms that apply to particular features.

You agree not to:

Use VidMagic to violate applicable laws or the rights of another person.
Upload, create, process, or distribute content that you do not have the right to use.
Infringe copyright, trademark, privacy, publicity, or other intellectual property rights.
Attempt to interfere with, damage, or gain unauthorized access to the App, its servers, or related systems.
Reverse engineer, decompile, or attempt to extract source code except where such restriction is prohibited by applicable law.
Circumvent access controls, subscription checks, usage limits, or security protections.
Use the Service to distribute malware, conduct fraud, or interfere with other users' use of the Service.

3. Intellectual Property

VidMagic, including its name, branding, interface, software, graphics, and original materials, is owned by or licensed to the operator, except for third-party materials and components identified as belonging to their respective owners.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for its intended purposes. This license does not transfer ownership of the App or its underlying intellectual property to you.

You may not copy, redistribute, sell, sublicense, modify, or create derivative versions of the App except where we authorize it or applicable law permits it.

Your Media and Exports

You retain the rights you already hold in the videos, images, audio, and other content you import into or create using VidMagic.

You are responsible for ensuring that you have the permissions and rights necessary to edit, upload, export, publish, or share your content.

VidMagic does not grant you rights to third-party music, footage, images, trademarks, or other content merely because editing tools are available in the App.

4. Video Processing and AI Features

Many standard editing operations are designed to run directly on your device. Certain AI-powered features may require an internet connection and transmit selected media or related information to remote servers for processing.

The availability, processing requirements, usage limits, and output quality of AI features may vary by feature, device, subscription, network conditions, and service provider.

AI-generated or automatically processed results may contain errors or unexpected output. You are responsible for reviewing results before relying on, publishing, or distributing them.

Do not submit confidential, sensitive, or third-party content to a cloud-based feature unless you have the right to do so and are comfortable with the applicable processing described in our Privacy Policy.

We may modify, limit, suspend, or discontinue individual AI features when reasonably necessary, subject to applicable law and any specific commitments made to you.

5. Internet Connectivity and Offline Use

Certain features require an active internet connection, including some cloud AI operations, account functions, advertising, analytics, and purchase verification.

Local editing and exporting features may continue to work offline where the feature does not require a remote service. Some online features may be unavailable without connectivity.

We do not guarantee that every feature will be available at all times or in every network environment.

You are responsible for any mobile data, roaming, internet access, or other connectivity charges imposed by your network provider.

6. Free Features, Advertisements, and Watermarks

VidMagic may provide free features supported by advertisements. Depending on the feature and current App configuration, free exports may include a VidMagic watermark.

We may offer an optional rewarded advertisement that allows you to export a particular video without a watermark. Such a reward is granted only after the applicable advertisement has been completed and the advertising system confirms the reward.

Rewarded-ad availability depends on connectivity, advertising inventory, regional restrictions, and third-party service availability. If a rewarded ad cannot be loaded or completed, the reward may not be available. Where supported, the normal export option may remain available.

Advertisement formats, availability, placement, and eligibility may change over time, subject to applicable law and platform requirements.

You must not manipulate advertising systems, falsify rewarded-ad completion, or attempt to obtain rewards through unauthorized methods.

7. Pro Features and Subscriptions

VidMagic may offer paid subscriptions or other in-app purchases that provide additional functionality. The benefits, price, duration, and eligibility of each purchase will be shown in the App or purchase interface before you confirm the transaction.

Depending on the plan offered, Pro benefits may include watermark-free exports, an ad-free experience, or access to additional features. Benefits may differ between plans and may change for future purchases, subject to applicable law and the terms presented at purchase.

7.1 Billing and payment

Purchases made through Google Play are processed by Google Play under the payment terms presented during purchase. We do not receive or store your complete payment card details merely because you purchase a subscription through Google Play.

The price, billing period, introductory offers, and any applicable taxes will be shown before you confirm your purchase.

7.2 Automatic renewal

If a subscription is offered as an automatically renewing subscription, it will renew according to the billing period and renewal terms displayed by Google Play at purchase, unless canceled before renewal in accordance with Google Play's instructions.

The applicable renewal price and date are determined by the subscription terms shown in Google Play. Please review those details before subscribing.

7.3 Free trials and introductory offers

A free trial or introductory offer is available only when explicitly displayed in the purchase interface. Its duration, eligibility, and conversion to a paid subscription will be disclosed before purchase.

If a trial converts to a paid subscription, cancellation must be completed before the trial ends in accordance with the terms displayed by Google Play to avoid the subsequent charge.

7.4 Cancellation

You can manage or cancel a Google Play subscription through Google Play's subscription settings. Uninstalling VidMagic does not, by itself, cancel a subscription.

Unless the purchase terms or applicable law provide otherwise, canceling a subscription stops future renewals but does not automatically refund the current billing period. Access to paid features generally continues until the end of the paid period.

7.5 One-time purchases

If a one-time purchase is offered, its price, benefits, and duration will be described in the purchase interface. A one-time purchase is not an automatically renewing subscription unless explicitly stated otherwise.

7.6 Purchases across devices

Subscription and purchase availability across devices depends on the platform, account, product configuration, and applicable store rules. A purchase made through Google Play may not be transferable to another platform.

Refunds, billing disputes, and purchase management are subject to the applicable store policies and consumer protection laws.

8. Refunds and Consumer Rights

Refund requests for purchases made through Google Play are handled according to the applicable Google Play policies and procedures, subject to applicable law.

Nothing in these Terms is intended to exclude or limit any consumer rights or remedies that cannot lawfully be excluded or limited in your jurisdiction.

9. Third-Party Services

VidMagic may integrate with or rely on third-party services, including advertising, analytics, authentication, cloud AI, hosting, and payment services. Those services may be subject to their own terms and privacy policies.

We are not responsible for third-party services that we do not control. Their availability and functionality may change independently of VidMagic.

Your use of third-party services may also be governed by the terms and policies of those providers.

10. Updates and Availability

We may release updates, fixes, improvements, or new features. Some updates may be necessary for continued use of certain features, compatibility, or security.

We do not guarantee that VidMagic or every feature will be uninterrupted, error-free, compatible with every device, or available indefinitely.

We may modify, suspend, or discontinue all or part of the Service when reasonably necessary. Where required by law or a specific paid-service commitment, we will comply with the applicable notice, refund, or other obligations.

11. Disclaimer of Warranties

To the extent permitted by applicable law, VidMagic is provided on an "as available" basis, without warranties that are not expressly provided or legally required.

We do not guarantee that the App will meet every user's requirements, that every export will succeed, or that AI-generated results will always be accurate, complete, or suitable for a particular purpose.

Nothing in these Terms excludes a warranty or protection that cannot lawfully be excluded under applicable law.

12. Limitation of Liability

To the extent permitted by applicable law, we will not be liable for indirect or consequential losses arising from your use of VidMagic, including losses caused by third-party service interruptions, network failures, device incompatibility, or your failure to maintain copies of important content.

We do not guarantee that user-created or imported media will always be preserved. You are responsible for maintaining backups of important original files and exported content.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability imposed by applicable consumer protection laws.

13. Suspension and Termination

You may stop using VidMagic at any time. If you have an account, you may request its deletion using the available account deletion process.

We may suspend or restrict access where reasonably necessary to address security risks, fraud, abuse, unlawful activity, serious violations of these Terms, or technical issues.

Where appropriate and legally required, we will provide notice or an opportunity to address the issue. Termination does not remove rights or obligations that arose before termination.

Account deletion does not automatically cancel a subscription purchased through Google Play. You must manage that subscription separately through Google Play.

14. Changes to These Terms

We may update these Terms to reflect changes in VidMagic, our services, business operations, or applicable law.

We will publish the revised Terms on this page and update the "Last updated" date. Where required by law, we will provide additional notice or obtain consent before changes take effect.

Your continued use of VidMagic after revised Terms take effect will be subject to those Terms to the extent permitted by applicable law.

15. Governing Law

These Terms are subject to the applicable laws governing the operator and the Service, taking into account any mandatory consumer protection laws that apply to you.
